Family Inheritance Drama Gets Messy

If she was given power of attorney by the deceased that's different and even then she had no right to go in and use his money.

My mom had everything, all her wishes, written out and had copies distributed to all 5 kids years before her death. My oldest sister held power of attorney because she lived the closest. We were so grateful for this when she passed. The only arguments were trying to get people to take what they were given. If they didn't want something, it was given to whoever actually wanted it.

My uncle had a hard time understanding that power of attorney ended at death. It want my grandpa wear the issue was . My great uncle died prior to my grandpa with no heirs. My uncle had power of attorney over the uncle, tried say that meant he recieved all my great uncle assets, even though the court through probate order the assets to be divided between my grandpa and his sister. My uncle tried to use the whole I got power of attorney so I get everything

I'm a big believer that if you know your demise is imminent, give away your assets and keepsakes before you pass. Make sure every recipient named in a will has a copy of the will and give your attorney the names and phone numbers of the recipients. Everyone should be aware of the wishes of the decedent before they pass.

I'm in California and currently going through the same thing. My sister abused the power of attorney. Not only did she open a personal trust, she's been transferring his $5000 VA benefit into it for the last 3 years (over $250,000) . She's also ghosted me and my other 2 siblings. She filed his will in South Carolina but stated there is no money to open probate. On top of all that. My father died before his Camp Lejeune settlement was completed. She plans on keeping that as well. Not to mention the numerous credit cards that are maxed. ( Navy federal card is maxed out at $25,000) She works at Wells Fargo in Charlotte making a $100,000 a year. Police can't help and finding a lawyer has been challenging!! Pray for us!!

I'm worried about my brother doing shady shit as the executer. When my mom was dying she moved all the stocks and money into her accounts. she had me read the wills and whole term life insurances so I know what is due me. But me being in florida my brother was made executer which was OK with me because the will was pretty basic dividing all monies and house divided between all 3 of us. I don't know how long probate takes but my brother is really not communicating info on probate which he is required to do. My other brother who lives in the house has to buy us out or leave both brothers are 59 and 60. My dad died 4 mos ago at 100. Do I need a lawyer? NY probate says probate usually takes 7 mos on straightforward will. House was paid for years ago. all credit cards paid. My dad has his own account so that's the only thing I know nothing about but my brother who lived in the house was responsible for paying the bills to maintain the house from it.Any ideas?
